Lowery Announces Litigation Filed Against State of Missouri

Mayor Robert G. Lowery, Sr. of Florissant announced that the City has filed litigation against the Department of Revenue for the State of Missouri for failure to distribute taxes owed the City of Florissant. Lowery said taxes collected by the State are, by law, required to be distributed based on population to all cities in the state. Those taxes include motor vehicle fuel tax, motor vehicle fee increases, motor vehicle sales tax, and cigarette tax. While the City has enjoyed successfully annexing 5 areas in recent years, the State, although notified many times beginning October 2008, neglected to pay the City of Florissant for additional population. As a result, a shortfall of $875,000 is owed the City of Florissant. The Mayor and the City Attorney have tried negotiations with the Governor’s office, both Blunt and Jay Nixon, the Attorney General and the Director of Revenue to no avail. Mayor Lowery said the State has not denied that the money is owed to the people of Florissant but have left the City no other option than litigation.
