{"id":2152,"date":"2009-09-24T12:56:01","date_gmt":"2009-09-24T18:56:01","guid":{"rendered":"http:\/\/www.flovalleynews.com\/?p=2152"},"modified":"2009-09-24T12:56:01","modified_gmt":"2009-09-24T18:56:01","slug":"florissant-considers-limiting-off-site-business-sale-events","status":"publish","type":"post","link":"https:\/\/flovalleynews.com\/?p=2152","title":{"rendered":"Florissant Considers Limiting Off-Site Business Sale Events"},"content":{"rendered":"<p><!--StartFragment--><\/p>\n<div class=\"Section1\">\n<p class=\"MsoNormal\"><strong>BY CAROL ARNETT<\/strong><\/p>\n<\/div>\n<div class=\"Section2\">\n<p class=\"MsoNormal\"><span><span> <\/span>The Florissant City Council met in an executive session last week before the regular council meeting to discuss two unrelated items: offsite sales and texting while driving.<\/span><\/p>\n<p class=\"MsoNormal\">\n<p class=\"MsoNormal\">\n<p class=\"MsoNormal\"><span><span> <\/span>The discussion about offsite sales was prompted by a sale that Johnny Londoff Chevrolet recently held at the Flower Valley Shopping Center. Londoff did not have the proper permits for the sale. <\/span><\/p>\n<p class=\"MsoNormal\"><span><span> <\/span>Councilwoman Karen McKay told the council that she had been working on a bill that would regulate such off-site sales. \u00e2\u20ac\u0153We want to be fair so that any business that wants to have offsite sales can,\u00e2\u20ac\u009d she said. However, she added, \u00e2\u20ac\u0153we have issues with shopping centers renting out space more than twice a year.\u00e2\u20ac\u009d <\/span><\/p>\n<p class=\"MsoNormal\"><span><span> <span> <\/span>McKay said the bill she proposed would allow businesses to have one offsite sale per year. The bill would allow each shopping center to host two sales per year. The fee for a sale would be $100.<\/span><\/span><\/p>\n<p class=\"MsoNormal\"><span><span> <\/span>\u00e2\u20ac\u0153We\u00e2\u20ac\u2122re trying to be business-friendly,\u00e2\u20ac\u009d McKay said. \u00e2\u20ac\u0153But we don\u00e2\u20ac\u2122t want shopping centers to lease their lots every weekend.\u00e2\u20ac\u009d <\/span><\/p>\n<p class=\"MsoNormal\"><span><span> <\/span>\u00e2\u20ac\u0153We\u00e2\u20ac\u2122re focusing on car dealers,\u00e2\u20ac\u009d said Councilman John Grib. \u00e2\u20ac\u0153What if a second hand shop wants to have a flea market?\u00e2\u20ac\u009d McKay responded that she was presenting the bill for a first reading, but wanted input from the council. <\/span><\/p>\n<p class=\"MsoNormal\"><span><span> <\/span>\u00e2\u20ac\u0153I\u00e2\u20ac\u2122m in concurrence with Ms. McKay,\u00e2\u20ac\u009d Mayor Robert Lowery said. He said regulating the sales was a good idea<\/span><span>.<span> <\/span><\/span><\/p>\n<p class=\"MsoNormal\"><span> At the regular council meeting, Johnny Londoff, Jr. apologized for the sale, but noted that it was \u00e2\u20ac\u0153a tremendous success for us and other businesses in the center.\u00e2\u20ac\u009d<\/span><\/p>\n<\/div>\n<p class=\"MsoNormal\"><span><span> <\/span>Londoff also stated that the dealer was planning another sale in the same place Sept. 23-26. <\/span><\/p>\n<p class=\"MsoNormal\"><span><span> <\/span>Councilman Tim Lee asked Londoff what he would do if the ordinance regulating the sales is not passed. He noted that the police had recently stopped other similar sales because they are not allowed under city ordinance. \u00e2\u20ac\u0153You understand that your\u00e2\u20ac\u2122 blatantly breaking the rules after apologizing for the first sale?\u00e2\u20ac\u009d he asked. <\/span><\/p>\n<p class=\"MsoNormal\"><span><span> <\/span>McKay told Londoff that while the city was trying to be business-friendly, you \u00e2\u20ac\u0153may end up with consequences, such as a court order to stop.\u00e2\u20ac\u009d<span> <\/span>She added, \u00e2\u20ac\u0153we have to let our administration enforce our laws.\u00e2\u20ac\u009d <\/span><\/p>\n<p class=\"MsoNormal\"><span><span> <\/span>The council held a first reading on the bill regulating the sales.<\/span><\/p>\n<p class=\"MsoNormal\" align=\"center\"><span><strong>Driving While Texting?<\/strong><\/span><\/p>\n<p class=\"MsoNormal\"><span><span> <\/span>The council also took up the issue of texting while driving. The state of Missouri recently enacted a law that makes it illegal for anyone under age 21 to text while driving.<\/span><\/p>\n<p class=\"MsoNormal\"><span><span> <\/span>\u00e2\u20ac\u0153This affects everyone, not just those under 21,\u00e2\u20ac\u009d Lowery said. \u00e2\u20ac\u0153Texting while driving is one of the most dangerous things you can do.\u00e2\u20ac\u009d Lowery asked the council to pass a law that would make texting illegal for all ages.<\/span><\/p>\n<p class=\"MsoNormal\"><span><span> <\/span>\u00e2\u20ac\u0153Philosophically, I agree with you,\u00e2\u20ac\u009d said City Attorney John Hessel. He then explained that there may be some problems with making texting illegal in the city. \u00e2\u20ac\u0153State laws regulate traffic offenses,\u00e2\u20ac\u009d Hessel said. \u00e2\u20ac\u0153You cannot impose any traffic regulations not imposed by the state.\u00e2\u20ac\u009d Hessel told the council that by imposing a regulation not imposed by the state, \u00e2\u20ac\u0153you may be opening a can of worms.\u00e2\u20ac\u009d <\/span><\/p>\n<p class=\"MsoNormal\"><span><span> <\/span>\u00e2\u20ac\u0153It\u00e2\u20ac\u2122s going to be a challenge,\u00e2\u20ac\u009d Lowery said. \u00e2\u20ac\u0153We need to do <\/span><\/p>\n<p class=\"MsoNormal\"><span>this, to be the first to do this.\u00e2\u20ac\u009d <\/span><\/p>\n<p class=\"MsoNormal\"><span><span> <\/span>Councilman Tim Lee asked if the police could issue careless and imprudent driving tickets to drivers who text. <\/span><\/p>\n<p class=\"MsoNormal\"><span><span> <\/span>\u00e2\u20ac\u0153That would mean they would have to be endangering others,\u00e2\u20ac\u009d Hessel said, \u00e2\u20ac\u0153and you would need evidence of that.\u00e2\u20ac\u009d<\/span><span> <\/span><\/p>\n<p><span><span> <\/span>The council held a first reading on the bill<\/span><!--EndFragment--><\/p>\n","protected":false},"excerpt":{"rendered":"<p>BY CAROL ARNETT The Florissant City Council met in an executive session last week before the regular council meeting to discuss two unrelated items: offsite sales and texting while driving.
